1. Who these terms apply to
These terms apply to your use of this website (fabriceficerai.com) and any services provided by Fabrice Ficerai (ABN 47 143 635 197), a sole trader operating under Australian law. By using this site or engaging my services, you agree to these terms.
2. Services
I provide website design, marketing, workflow automation, and AI integration services. The specific scope, timeline, and cost of any engagement are agreed in writing before work begins — typically via a proposal or statement of work. These terms apply alongside that agreement; where there is a conflict, the specific project agreement takes precedence.
3. Payments
Payment terms are set out in each project agreement or invoice. Unless otherwise agreed, invoices are due within 14 days of issue. Late payments may attract interest at the rate permitted under the Penalty Interest Rates Act 1983 (Vic). I reserve the right to pause work on any project with an outstanding overdue balance.
4. Intellectual property
Upon receipt of full payment, you own the final deliverables created specifically for your project (custom designs, copy, configurations). I retain ownership of any tools, frameworks, templates, or pre-existing code used to build those deliverables, and reserve the right to reuse those elements in other projects.
All content on this website — text, graphics, and code — remains the property of Fabrice Ficerai unless explicitly stated otherwise.
5. Your responsibilities
You agree to:
- Provide accurate information and timely feedback needed to complete the work.
- Ensure you have the rights to any content, images, or materials you supply to me.
- Not use this website or my services for any unlawful purpose.
- Not attempt to reverse-engineer, copy, or resell my proprietary tools or systems.
6. Limitation of liability
To the fullest extent permitted by law, my liability for any claim arising out of services provided is limited to the amount paid for those services in the preceding three months. I am not liable for indirect, consequential, or incidental losses, including loss of revenue or data.
Nothing in these terms excludes any consumer guarantee or right you have under the Australian Consumer Law that cannot lawfully be excluded.
7. Governing law
These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
8. Changes
I may update these terms from time to time. The date at the top of this page reflects when they were last revised. Continued use of this site after changes are posted constitutes acceptance.
